DOTHAN:    9:58 PM      Dothan Police 911 dispatched police - fire - EMS to 3300 South Oates Street, Wal-Mart, to where a person pepper sprayed a female, two children and a male.

Dothan Fire Engine 2 ( Lakewood ), Pilcher Ambulance and Dothan Fire responded to the Grocery entrance. A suspect was quickly identified and police located the suspect at his residence.

This version is close to the set of circumstances. The suspect did not like the male subject with the female. He went to pepper spray and got the female and children instead. While the male was protecting the female and children the male subject was able to flee the scene.

Because the offense is a misdemeanor the suspect could not immediately be taken into custody.

SELF DEFENSE:   If attacked, if you or someone else is in danger of serious injury or death, you have the right to defend yourself "as long as you or someone else are under immediate threat of serious injury or death ".

If the suspect is fleeing, running away from you, then you do not have the right to use physical force or deadly physical force. Because running away from you, you then can not articulate that you or someone else is in immediate danger or serious physical injury or death.

You can not shoot someone running away. Because you can not articulate that you or someone else was in danger of serious physical injury or death when they are running away.

The above statements are as I understand self defense. Do not take that as legal advise and make sure you discuss with a law enforcement officer or attorney before taking my word for it.

With that said, sometimes a misdemeanor assault is worth it if someone pepper sprays my children and wife. Regardless of the reason, this guy needed his rear kicked for pepper spraying the children most especially.

But it is best to let the system handle it. 

No one was transported to a medical facility and the children are ok.
