Forehand Faces Capital Murder Charges

HOUSTON COUNTY:    On July 4th shortly before midnight the Houston County Sheriff 911 Center rolled deputies to Cottonwood Road to a shooting. A brother shot a brother.

In the end Andrew Forehand was dead on the scene. And Matthew Preston Forehand was under arrest and in the Houston County Jail.

Matthew Preston Forehand is charged with Capital Murder. This is a death penalty offense. Normally there is no bond in Capital Murder cases.

To go from murder to capital murder means there are allegations that another crime occurred. The Houston County Sheriff Department had answered a call at the same location of the murder earlier in the night.

The complaint with the warrant reads " On or about July 4, 2018 Matthew Preston Forehand did intentionally cause the death of Andrew Shelly Forehand by shooting him in the face with a Moison Nagant Bolt Action Rife, and he caused the death during the time he knowingly and unlawfully entered or remained, or attempted to enter or remain, unlawfully in the dwelling of Avis Andrews Forehand, with the intent to commit the crime of murder, therein, and while effecting entry or was in the dwelling or in immediate flight therefrom, said Matthew Preston Forehand, was armed with a deadly weapon or an explosive, to wit, a Moison Nagant Bolt Action Rifle."

Forehand is scheduled to appear before the Honorable Benjamin Lewis this morning for initial appearance. Where Judge Lewis will appoint legal counsel for Forehand.

Houston County Sheriff Department is expected to call a press conference sometime next week. Even though this will be old news by the time they have a press conference.

Houston County Sheriff Criminal Investigators worked the scene all night.
