HENRY COUNTY Three Judges Have Dockets Only One Main Courtrooom - Capital Case Scheduled

HENRY COUNTY:    For the second consecutive week 20th Judicial Circuit Court Judge Larry ANderson has criminal jury trials scheduled which include a Capital Murder, Attempted Murder and Promoting Prison Contraband case.


Last week Judge Anderson had a Capital Murder case all week in Houston County and now again another Capital Murder Case along with Attempted Murder and Promoting Prison Contraband involving Herman Cunningham in Henry County.


Judge Anderson has 49 cases scheduled on his Henry County Criminal Jury Trial Docket. Those cases range from minor cases to major cases such as Trafficking.


20th Judicial Circuit Court Judge John John Steensland has one divorce case scheduled in Henry County.


20th Judicial Circuit Court Judge Todd Derrick has one divorce case scheduled in Henry County.


The courthouse has one large courtroom on the second floor and the County Commission Courtroom on the first floor.


STATE OF ALABAMA vs. HERMAN CUNNINGHAM - Capital Murder, Attempted Murder, Promoting Prison Contraband


Herman Cunningham is alleged to have committed the crime of auto theft of a 1996 Mercury Grand Marquis. While in the commission of that auto theft from victim Apollinar Perez, Cunningham is alleged to have used force by inflicting sharpe force trauma to the victim with an edged weapon and caused the death of Apollinar Perez.


While in the Henry County Jail, on 07/09/2017 Cunningham was charged with Attempted Murder. The allegations are Cunningham attempted to cause the death of Calvin Morris by cutting his throat with a razor blade. Both Cunningham and Morris were inmates in the Henry County Jail.


Also Cunningham was charged with Promoting Prison Contraband because  of his Possession of a razor blade that was alleged to be the weapon Cunningham used to cut the throat of Morris.


This case has been one where 20th Judicial Circuit Court Judge Larry Anderson has been pitching his temper tantrums in court trying to get this case to trial. One legitimate excuse has been the poor excuse of the Alabama Department of Mental Health in determining if Cunningham is mentally capable of standing trial. There has been a lot of going back and forth between the 20th Judicial District Attorney Office and Defense Counsel, Judge Anderson and the Alabama Department of Mental Health.


Now Sam Clenny, Assistant District Attorney of the 20th Judicial Circuit has filed a motion that comes with the common pattern, practice and scheme in Henry County. They can not finding the search warrant executed in this case on March 9, 2011.


The search warrant was executed by the Henry County/Abbeville Joint Task Force. And as of the court filing on April 5, 2019 they have been unable to find the search warrant. Clenny is asking Judge Anderson to make a pre-trial determination on evidence taken from Cunningham’s residence and if that evidence can be admitted to court without the search warrant copy.


Judge Anderson has already been pitching Gerber Baby Temper Tantrums for months concerning this case. Abbeville Rescue might need to be on stand by Monday when this issue comes up. Judge Anderson is known for blowing gaskets and tempter tantrums so this might be entertaining.


And Henry County agencies have a common plan, scheme and design apparently cause they are always loosing something.


Perhaps if some would spend more time doing their jobs rather than running those mouths about each other, sticking knife blades in each other’s backs, sticking their noses where they do not belong, then, maybe they would not keep loosing things. You know who I am talking about! ( And it ain't the Sheriff Department ladies ).


If Cunningham is convicted he could face the death penalty.


So Judge Anderson kicks of second week of criminal jury trial.
