Al.com is reporting that... Montgomery County Circuit Court Judge Roman Shaul declared a mistrial Tuesday in a 2014 attempted murder and assault case after a witness was killed shortly after his testimony on Monday, court records said.
Kelvin Cooley, 31, was shot dead in his car which was parked outside the Montgomery County Courthouse on South Lawrence Street around 5 p.m. on Monday. Court documents state the shooting happened approximately 10 minutes after Cooley left the stand during the first day of trial for a case involving 27-year-old Jacquees Boone. Cooley was transported to the hospital with a life-threatening gunshot wound on Monday afternoon. He passed away Tuesday morning.
Cooley was the brother of Alondre Cooley, who was shot in the face by Boone in March 2014. Court documents said Alondre Cooley suffered life-threatening injuries from the shooting. Boone was previously convicted of the 2014 case, but the Alabama Supreme Court threw it out due to evidence presented during the first trial.
