Montgomery Officer Denied Immunity, Granted Change of Venue in Murder Trial

MONTGOMERY, AL (WSFA) - The Alabama Supreme Court has handed a victory to the defense in the case of Montgomery police officer Aaron “Cody” Smith, though only partially.
On Friday, the court granted Smith’s petition to order Circuit Court Judge Greg Griffin’s recusal and granted a petition for a change of venue outside of Montgomery County.
Smith’s attorneys didn’t get everything they appealed to the high court for, however. Their client’s petition for immunity from prosecution was denied.
