Murder Suspects Collins and Givens Have Initial Appearences

DOTHAN:    Dothan Police arrested 24 year old Dentavious Jamal Givens and 20 year old Jatavion Lakeldrick Collins for the murder that occurred on Monday.

Both Givens and Collins are booked into the Houston County Jail on no bonds as per 20th Judicial Circuit Court Judge Kevin Moulton.

Givens is charged with the September 10, 2018 murder inwhere the allegations are he caused the death of an individual with their hands and unknown blunt objects causing severe physical injuries and head trauma in which resulted in Neal Barber’s death.

Collins is charged with the September 10, 2018 murder inwhere the allegations are he caused the death of an individual by as Neal Barber was attempting to escape and seek help Collins chased him down and drug him back to Givens where Givens contimued to beat Barber until he succumbed to his injuries.

Givens listed an address of 304 Pettus Street and Collins listed an address of 613 Monument Street, both in Dothan.

The first appearance was held this morning via TV from the Houston County Jail to the Houston County Courthouse. Initial appearance was before the Honorable Benjamin Lewis, District Court Judge for Houston County.

At this court appearance Judge Lewis informs each defendant of their charges, their right to remain silent, the sentence range for the offense charged, right to a preliminary hearing, and seeks information on their financial ability to employ legal counsel of for legal counsel to be appointed for them.

Arrests occur one of three ways; (1) on view (2) arrest warrant (3) Grand Jury indictment. Arrests listed in 1 and 2 begin in District Court where arrest listed in 3 begin in Circuit Court.

However every felony in Alabama has to go before Grand Jury before making it’s way into Circuit Court.

These two arrests started "on view" and then the Dothan Police Criminal Investigator obtained arrest warrants. To get bonds outside the bond schedule they must see a judge and in these cases Circuit Court Judge Kevin Moulton set a "no bond". One of the factors considered was the danger to the community.

Because these cases begin in District Court they are entitled to a Preliminary Hearing. In these hearings the rules of evidence are not strict, hearsay is admissible. The burden for the state is probably a crime occurred and probably these persons committed the crime.

After the preliminary hearing the cases will go before a Houston County Grand Jury. These are 18 people who meet in secret, they normally only hear prosecution witnesses. Once an indictment is issued the case makes it’s way to Circuit Court.

If indicted by a Grand Jury, Givens is assigned to the Honorable Circuit Court Judge Todd Derrick. Judge Lewis appointed Attorney Ben Freeman to represent Givens.

If indicted by a Grand Jury, Collins is assigned to the Honorable Circuit Court Judge Butch Binford. Judge Lewis appointed Attorney Matt Lamere to represent Collins.

A person is presumed innocent until proven guilty in a court of law or enters a guilty plea in a court of law. They have the right to seek a bond hearing. They have requested on which is set for next Thursday before Honorable Judge Benjamin Lewis.
