20th JUDICIAL CIRCUIT - HOUSTON COUNTY: This week 20th Judicial Circuit Court Judge Butch Binford has been making everyone toe the line and work extremely hard.
A Capital Murder case this week involving Joshua Steven Nance, where Nance faced the death penalty if convicted, Judge Binford has kept the case on course and moving. Judge Binfored told the attorneys in this case if they had to make plans to be in court over the weekend.
Nance was arrested by Houston County Sheriff Department in the January 4, 2016 murder of Paxton Kennedy. Three others were arrested in the same death.
Nance was accused of shooting Kennedy in the head with a .380 pistol while sitting in the vehicle.
Nance was represented by Shaun McGhee and Derek Yarbrough in this case. From the beginning, prior to the trial, McGhee and Yarbrough told The 20th Judicial Circuit District Attorney’s Office, at worse, this was not a Capital Murder case but a manslaughter case.
In opening statements and throughout the trial Shaun McGhee and Derek Yarbrough kept telling the jury this was not a death penalty Capital Murder case but a Manslaugther case.
This afternoon the jury of 12 peers of Joshua Stephen Nance returned a verdict of Manslaughter in this case.
Judge Binford will seek a pre-sentence investigation report by the Alabama Pardons and Parole Board prior to sentencing.
Judge Binford has handled a lot of cases this week. In this murder trial since Tuesday. He has taken guilty pleas in cases on breaks, before the trial started and after the trials have ended for the day. He has basically worked his butt off.
Judge Binford has also been appointed by the Chief Justice of the Alabama Supreme Court to be the Judge in a case in another part of the state. The Judges in that Circuit have a conflict and he will be going across the state to handle trials in those counties next week.
