HOUSTON COUNTY:    A Houston County jury of peers found Mikal Kenneth Manning not guilty of  Unlawful Manufacturing of A Controlled Substance and guilty of Unlawful Possession of a Controlled Substance.

On March 24, 2016 Dothan Police arrested Manning and charged him with Unlawful Manufacturing of A Controlled Substance.

Manning was represented by Dothan Attorney Shaun McGhee and the case was before 20th Judicial Circuit Court Judge Butch Binford. The State of Alabama was represented  by 20th Judicial Circuit Assistant District Attorney Seth Brooks.

Manning claimed he was not manufacturing a controlled substance. He had been at a residence for about 25 minutes when police arrived. He was charged with Unlawful Manufacturing of a Controlled Substance.

After the presentation of the case, the jury of 12 peers did not convict Manning of Unlawful Manufacturing of A Controlled Substance. They convicted him of Unlawful Possession of a Controlled Substance.

Manning was taken into custody. Manning will not be sentenced until next month.

That is a far cry from what the 20th Judicial Circuit District Attorney's Office had in mind for him should he had been convicted of the Unlawful Manufacturing of a Controlled Substance. The sentence would have been 15 to 20 years.

On the conviction handed down by the jury of 12, the sentencing guidelines call for maximum of 64 months.

Shaun McGhee is a private practice attorney in Dothan Alabama.
