HOUSTON - HENRY - DALE - COFFEE- GENEVA - PILE - BARBOUR:     Over the years we have not covered a lot of what is happening in court other than particular cases. We are now going to start following court activity and “behind the scenes” of the courthouses and municipal courts.

COURT WATCH

(1) When the law reads “the court”, what does that mean?

(2) Send emails to [email protected] with what your definition of “the court” is. Curious what the public thinks.

SOMETHING I HAVE NEVER FIGURED OUT IN HOUSTON COUNTY

Since the days Bill McFatter served as District Court Judge in Houston County, and continues today. Even happened today.

District Court typically has huge dockets for traffic court and preliminary hearings. With people not able to get into the courtroom, standing in the doorway and outside the courtroom. The Dothan Fire Marshall would close the courtroom if he or she appeared or had the courage to appear and challenge the Judge ( Court ).

But District Court is held on the second floor in a small courtroom. Meanwhile on the 4th floor is a huge courtroom. Other than jury duty day the courtroom is empty or very few people in it.

Why in the world does the court system not use common sense and have the huge court docket days in the 4th floor courtroom rather than the smallest courtroom?

I realize common sense is to be used. Not sure who makes the courtroom assignments when the dockets are prepared.

I know the dockets are prepared by the Circuit Clerk’s Office ( Carla Woodall ) but I don’t know who makes the decision.

UPDATED NOTE:

The Clerk’s do not make courtroom assignments. They only do what they are told.

I have no idea who makes the decision of what courtrooms Judges have. But going back to the McFatter days this decisions needs to be rethinked.

But if you interpreted me to say the courtroom assignments are made by the Clerk of Court that is wrong.

Something I have wondered for years. Today in District Court in Houston County was Traffic Court. People were in the hallway and could not get into the courtroom.
