UPDATED SATURDAY MORNING AT 9:05 AM. Honorable Benjamin Lewis Holds Preliminary Hearings Today

HOUSTON COUNTY:     The Honorable Benjamin Lewis held preliminary hearings today in the Houston County Courthouse. Multiple cases were hear and resolved today with Judge Lewis work.

Prelimiary Hearings are “probable cause“ hearings. Probably a crime was committed and probably this person did it. The rules of evidence are extremely lack.

A good way of explanation, a police officer could testify to what victim would say. The actual rape victim does not always have to testify. The burdens and restrictions of evidence are veery slim.

Today the case were are focus on was a Capital Murder case. The case where Matthew Preston Forehand was in court on charges of Capital Murder in the death of his brother Andrew Forehand.

This was a shooting death on Cottonwood Road on July 4th. When the Sheriff Department arrived the suspect, Matthew Preston Forehand, was stil on the scene. The brother was dead on the scene.

After hearing testimony Judge Benjamin Lewis took the court case under advisement. He is expected t issue a ruling next week.

Testimony was that Andrew Forehand has been a issue and made threats. The incident occurred at the grandparents residence where Andrew Forehand has caused repeated trouble over the past.

A ruling is expected next week. It is not believed that Judge Lewis will bind the defendant, Matthew Preston Forehand, over on the charges of Capital Murder but possibly reduce the charges.

Judge Benjamin Lewis is EAT UP with common sense. A rare factor around Judges. Most Judges get caught up in the power, the setting up on a throne in a big black dchair with a $ 150,000.00 a year salary. They feel they know everything and can talk down to everyone.

But Judge Lewis DOES NOT fit that mold. He is a Judge that explains the process, listens to the evidence, rules on common sense and the law.

A great Judge.

IN THE ABOVE COMMENTS I HAVE CORRECTED MY MISTAKE. I used Avis Andrews Forehand as the deceased. It was Andrew Forehand, who everyone called Drew, that was killed.

UNINTENTIONALLY I used Avis in front of Andrews name. Avis is the grandmother and had nothing to do with the incident. Ms. Avis is a nice grandmother lady, who is alive.

This incident has been devastating for all. But was brought on a lot by Andrew “Drew” Forehand’s unacceptable behavior towards his family. Will not go into a lot of details.

THANKS to the one who set me straight. And I thank the person. Always want to get the information correct.
