NOTE From Jury: We have reached unanimous consent on some counts but we feel we will never reach unanimous consent on all counts. The defendants attorneys are meeting now.
4:26 Judge Thompson is passing out copies of the message and he will read it into the record.
We have reached unanimous consent on some counts but we feel we will never reach unanimous consent on all counts.
Judge Thompson has asked the defendants what they want to do. They are meeting together to discuss.
4:47 the Court is ready to proceed. Judge Thompson is entering the room.
Government first:
Mr. Shurr, the government has reviewed the note and the government would suggest that the court instruct the jury to go back and continue deliberation and giving the tone of the note the Judge should maybe instruct that if they have any questions on the unresolved counts they should send additional notes to the court.
Espy for McGregor: McGregor requests that the jury continue their deliberations. We suggest that you continue your deliberations.
Coker: We agree with Espy
Geddy: Disagrees I think a question that is important has the jury completely decided the case as to any defendant. If it has I think the court needs to hear that.
Means: Disagrees with GEddy’s position and agree with Mr. McGregor.
Pruitt: I agree with McGregor and would emphasize that I agree a lot more with not using the government’s language on the questions.
Ross: With regard to Mr. Ross generally we agree with McGregor position but they think that the court should make inquiry as to if they have reached decisions on all counts of any defendant.
Smith: All my friends are taking different positions here, I am divided but I told McGregor’s attorney that I would agree with them.
Walker: Agree with Senator Ross
Crosby: Agree with Senator Ross and to further deliberations suggested by Espy.
Judge Thompson will ask them to continue their deliberations. If after further deliberations they have still not reached a decision then we will talk further.
Jury is coming in.
Members of the jury. Judge Thompson is reading the note. I’ve considered your note and I ask that you continue with your deliberations. Would you like to deliberate further tonight or continue tomorrow. They will continue at 9 tomorrow.
Jury is excused, counsel please remain.
Judge Thompson says the only advice I would give you is depending on what happens tomorrow we may have a verdict. I suggest you are close by with your clients.
