LEVEL PLAINS - DALE COUNTY - PANAMA CITY BEACH POLICE:     2:05 PM SUNDAY;   As of the writing of this article Level Plains Police Chief Billy Driggers remains in the Dale County Jail.


Driggers, who is on Administrative Leave, was arrested on October 4, 2018 in a joint arrest by Dale County Sheriff Deputies, Alabama Department of Law Enforcement - State Bureau of Investigation Division and Panama City Beach Police.


Unless arrested by a bail bondsman, a defendant arrested by a law enforcement agency has the right to sign a Waiver of Extradition before the out of state agency can pick them up. Should the defendant refuse to sign a Waiver of Extradition, the state with the charges, in this case, Panama City Beach Florida, has to get a Florida Governor’s Warrant. 


Once the state with the charges gets the Governor’s Warrant, the state having custody, in this case Alabama, the Governor has to agree.


At that point depending on all systems go, the arresting aganecy has ten days to come pickup the defendant. Some agencies do that themselves and some contract with a commercial prisoner transport.


Until that process works out, Drigger’s remains in the Dale County Jail for at least 30 days. That is provided he has not already signed a waiver of Extradition.


If Driggers has signed it, the arresting agency has 10 days to pick him up.


Driggers was arrested on a misdemeanor arrest warrant from Panama City Beach Police. That is unusual. Normally misdemeanor offenses do not cross state line borders.


Driggers is accused, which was captured on video, of masturbating in front of girls while in Panama City Beach.


Driggers has worked for various agencies in Dale County area, to include Ozark Police and Daleville Police.


Driggers is certified by the Alabama Peace Officers Association, which is commanded by Executive Secretary Alan Bennefield. Bennefield served as a long time Ozark Police Chief. He ran for Ozark Mayor, got his fanny whipped like a dog. Then someone got him a job in Montgomery over the certification of all Alabama Law Enforcement Officers. Bennefield was notified via text of Driggers arrest this past Thursday.


It is up to Alan Bennefield and his APOST board if Driggers remains a certified Alabama Law Enforcement Officer.


Pattern and Practice, a former Dothan Criminal Investigator was terminated from Dothan Police Department for having a sexual relationship with a rape victim of which he was sent to investigate the rape. Not only did the investigator arrest a person on false charges, the investigator started a relationship ( personal and alleged sexual ) with the rape victim. Dothan fired him.


Dothan Police Department refused to allow such conduct. You will not wear a badge for Dothan Police Department and have relationships to include possible sexual relationships with rape victims. Most importantly those who their safety has been entrusted to you as an investigator.


The former Dothan Officer went to other agencies and now serves as a Police Chief of a small Dale County municipality. Benefield has allowed the former Dothan Officer to remain a police officer in Dale County Even serving as Police Chief.


So what Bennefield and his group will do, pattern and practice, continue to allow some sexual predators to continue wearing badges in Alabama. Especially those from Benefield’s home county of Dale County.
