DALE COUNTY—A judge in Dale County is deciding whether or not to grant bond to a man investigators claim tied up and murdered a woman in her bedroom over the weekend.

James Johnson, 29, is charged with murdering 57-year-old Sherry Clark.

After a welfare check when she did not show up for work, Clark was found nude, bound, gagged and dead in her bedroom in Midland City early Sunday, according to Dale County Sheriff Mason Bynum.

A preliminary autopsy revealed Clark died from blunt force trauma to the head and had cuts on her chest and genital areas. Her brain sustained significant damage after a hit to the front of her head caused a brain bleed. She was revealed to have died between 11 p.m. Saturday and 3 a.m. Sunday.

Johnson claimed he and Clark knew each other and had been occasionally sexually involved in the past. Johnson had just been released from prison in Florida, and investigators found a long record of charges of burglary, theft, and drug convictions.

Johnson appeared at his Aniah's Law hearing, where a prosecutor argued he should be denied bond due to the "brutal" nature of the crime.

Aniah's Law is to provide judges with more authority to deny bail to individuals charged with serious crimes like murder. If the judge finds the defendant may be a flight risk or a further danger to the community, the defendant can remain in custody.

Johnson's attorney argued the state had no evidence against Johnson and the information the state had was circumstantial. The attorney further noted Johnson did not have a violent past and showed up to previous court cases.

If given bond and released, Johnson would have to wear an ankle monitor.

The judge is expected to rule by the end of the week.
