COURTWATCH:     We which is I, Rickey Stokes, fell behind on COURTWATCH last week. So I am going to catch up on it this week.


Some days the court system computer is down and no one, not even the court personnel can access anything in the court system.


 


JANUARY 24, 2019  THURSDAY


 


HOUSTON COUNTY DISTRICT COURT JUDGE HONORABLE BENJAMIN LEWIS    District Criminal docket of 24 cases scheduled at 9:00 AM. Those cases are bond hearings, appearance dockets.


Following the District Criminal Docket Judge Lewis has 4 Domestic Relations cases set for Protection From Abuse cases. These cases begin at 9:30 AM.


Following those cases, at 10:30 AM, Judge Lewis has 3 District Civil cases of Unlawful Detainer. These are cases where landlords are working to evict persons from their homes.


At 10:30 AM Judge Lewis has one Small Claims Case, Motion to Reduce Garnishment. A case where Freedom First Financial Services filed a lawsuit and won the case. They have filed a garnishment and the defendant is seeking relief from the amount of money they are removing from their paycheck.


20th JUDICIAL CIRCUIT COURT JUDGE BUTCH BINFORD  has a Circuit Civil case. This is a Motion To Clarify an issue in a civil case.


Following this case Judge Binford moves into a Contested Divorce case.


20th JUDICIAL CIRCUIT COURT JUDGE KEVIN MOULTON has 5 Circuit Civil cases scheduled. One case is a Lift Stay of Discovery, a Motion to Dismiss one party in a civil case, a Bench where 20th Judicial Circuit District Attorney is attempting to take a 2008 Mustang from a defendant claiming it is “fruits of the crime”. There is a second bench trial with same allegation “fruits of the crime” but the docket does not read what he Fruits of the crime are.


Case Number CV 2018 – 900573


The defendant had $ 1,413.00 and a High Point .45. Dothan Police Vice unit received information the defendant, Dwight Thomas, was selling synthetic marijuana. Dothan Vice stopped the defendant and found a damiana leaf, typically used for synthetic marijuana, 7 grams of synthetic marijuana was found in the console, and 5 plastic bags holding a green plant substance. Following a traffic stop a search warrant was executed for the Thomas residence where 183.4 grams of synthetic marijuana was found, 10 grams of synthetic analog chemical, one High Point .45 handgun, and U.S. Currency.


The case was continued pending the disposition of the criminal case.


Case Number CV 2017 – 900321


The defendant, Keith Bernard Bagwell, owns one 2008 Ford Mustang and one Zestava Firearm. Dothan Police stopped a vehicle on April 9, 2017 in the 400 block of Morgan Street because the vehicle was possibly involved in a disorderly person call. There was a smell of odor of marijuana in the vehicle. A search produced marijuana and the firearm.


No disposition in ALACOURT at this time.


From that docket Judge Moulton moves into a Non Compliance with a Court Referral Officer case on Unlawful Use of Drug Paraphernalia.


 


JANUARY 25, 2019   FRIDAY


HOUSTON COUNTY DISTRICT COURT JUDGE HONORABLE BENJAMIN LEWIS    has the routine initial appearance conducted from the Houston County Jail to the Houston County Courthouse  via closed circuit TV.


From that docket Judge Lewis moves into a District Criminal Docket where 7 cases are docketed. Appearance docket before the Judge to see the status of the case.


 


JANUARY 28, 2019  MONDAY


HOUSTON COUNTY DISTRICT COURT JUDGE HONORABLE BENJAMIN LEWIS    will conduct Initial Appearance which are done five days a week and on holidays. These are done via closed circuit TV from the Houston County Jail to the courtroom.


Following Initial Appearances Judge Lewis moves into District Criminal cases where 44 cases are scheduled at 9:00 AM. These are Bench Trial cases to include Criminal Mischief, Possession of Marijuana, Hunting Over Baited Field, Hunting Without License, Domestic Violence, Public Intoxication, Health Violation ( where they did not pay $ 15.00 mandatory garbage bill ), selling cigarettes to a minor, etc.


Following the District Criminal docket Judge Lewis moves into one Domestic Relations case on a Protection From Abuse case.


20th JUDICIAL CIRCUIT COURT JUDGE HONORABLE JOHN JOHN STEENSLAND has four Circuit Civil cases scheduled. Motion for Default judgment, Temporary Restraining Order, Default Judgment, and Judge on Pleadings.


Judge Steensland will then move into Domestic Relations Issues where two cases are scheduled, Petition for Witholding Order and a Final Hearing on a Divorce.


20th JUDICIAL CIRCUIT COURT JUDGE HONORABLE KEVIN MOULTON has three cases set on civil cases. A Motion For Default Judgement, Hearing on a Petition To Modify on a divorce case, and a bench trial on a contested divorce.


20th JUDICIAL CIRCUIT COURT JUDGE HONORABLE LARRY ANDERSON has a negligence Motor Vehicle case on Summary Judgment.


20th JUDICIAL CIRCUIT COURT JUDGE HONORABLE BUTCH BINFORD has criminal jury trials in Henry County this week. Some 84 cases are scheduled before Judge Binford. These cases include Possess/Receive Controlled Substance, Burglary, Possession of Forged Instrument, Sodomy, Trafficking, etc.


JANUARY 29, 2019 TUESDAY


 


20th JUDICIAL CIRCUIT COURT JUDGE HONORABLE KEVIN MOULTON has domestic relations docket with 5 cases set. Petition to Modify on a divorce status review, Legal Separation hearing, Petition For Custody hearing, Contested Divorce Status Review, and a Motion To Compel on a Contempt Domestic Relations matter.


HOUSTON COUNTY DISTRICT COURT JUDGE HONORABLE LORI COLLIER INGRAM has 27 Child Support cases scheduled.


Following the child support Judge Ingram has 2 Domestic Relations cases, one being contempt and one being Petition To Modify.


20th JUDICIAL CIRCUIT COURT JUDGE HONORABLE LARRY ANDERSON has two domestic relations cases scheduled. One is a Petition To Modify bench trial and one is a Petition For Custody Hearing.


20th JUDICIAL CIRCUIT COURT JUDGE HONORABLE TODD DERRICK has a Circuit Civil docket of 28 cases set for 1:30 PM. A lot of negligence motor vehicle cases, abandoned vehicle case, default judgment for quiet title, and status conferences to see where cases are at for final action.


Following the Circuit Civil cases Judge Derrick has7 Domestic Relations cases set for contested divorces, Petition To Modify, Petition for custody.


20th JUDICIAL CIRCUIT COURT JUDGE HONORABLE JOHN JOHN STEENSLAND has Circuit Criminal Cases scheduled in Henry County today. Judge Steensland has 7 Civil cases set. Following these cases Judge Steensland has 5 domestic relations cases on contested divorces.


In Henry County there is one main courtroom. When two Judges are scheduled the large courtroom is used for jury trials and the second Circuit Judge will use the Commission Chambers.


Henry County District Court Judge Honorable Derek Peterson will use his office.


20th JUDICIAL CIRCUIT COURT JUDGE BUTCH BINFORD AND HOUSTON COUNTY DISTRICT COURT JUDGE LORI COLLIER INGRAM holds juvenile cases and dockets are not available for public view because they involve juveniles. So at times you will not see dockets for these Judges because they are dockets not available for public view.


Also Judges have to schedule time in the office to research legal issues, prepare orders and do Administrative work.
