To serve in the Alabama House of Representatives, a candidate must meet the following constitutional requirements: [1, 2]
- Age: At least 21 years old at the time of the election.
- Citizenship: A citizen of the state of Alabama for at least 3 years.
- District Residency: A resident of their specific legislative district for at least 1 year immediately preceding the election.
- Voter Status: Must be a qualified registered voter.
- Term Limits: There are no term limits for members of the Alabama House of Representatives. [1, 2, 3]
HOUSTON AND HENRY COUNTY: Alabama House District 85 makes up Henry County and portions of Houston County. There are two candidates, Incumbent Rick Rehm ( R ) and Aristotle Kirkland ( D ).
Aristotle Kirkland is a former District 2 Dothan Commissioner. The RSN investigation is that Aristotle Kirkland does not live in District 85, but rather lives in District 86 which is represented by Paul Lee.
The election is November 3. Should Aristotle Kirkland be successful and win the race, he could not be declared the winner as he does not meet the qualifications. Which are, “a resident of their specific legislative district for at least 1 year immediately preceding the election.”
Artistotle Kirkland, when he qualified for District 2 Dothan Commissioner in 2021 used the address of 144 Radford Circle. On January 6, 2025 Kirkland purchased 606 Alabama Avenue, Dothan from David Dumas. The tax bill, according to Houston County Revenue Department, does not 144 Radford Circle. Both Radford Circle and Alabama Avenue are presently in Aristotle Kirkland’s name.
However, Aristotle Kirkland resides at 144 Radford Circle. Checks on the residence confirm that Kirkland resides on Radford Circle.
Pictures obtained on the inside of 606 Alabama Avenue clearly show the house is inhabitable and not being remodeled. So it can not be said he is remodeling the house.
RSN has brought this to the attention of Houston County Circuit Court Clerk Carla Woodall and Houston County Probate Judge Patrick Davenport. UNCONFIRMED reports possibly being reported to the Houston County Sheriff Department.
Ironically, when Aristotle Kirkland ran for District 2 Dothan Commissioner, Kirkland made accusations that Phillipe Kirksey did not live in District 2. It appears the same is true in the District 85 race.
